Federal Agencies Focus on Religious Discrimination On August 26th, the U.S. Department of Health and Human Services issued a Notice of Proposed Rulemaking that would prohibit discrimination against workers or applicants for training or study by organizations receiving certain federal funds based on the individual's "religious beliefs or moral convictions." On July 22nd the U.S. Equal Employment Opportunity Commission ("EEOC") issued an update to its compliance manual on religious discrimination. Why the increased attention on religious discrimination in the workplace? The EEOC reports religious discrimination charge filings with the agency nationwide have risen substantially over the past 15 years, doubling from 1,388 in Fiscal Year (FY) 1992 to a record level of 2,880 in FY 2007. Of particular note is a dramatic increase of nearly 21% in FY 2002, immediately following the events of 9/11. Interestingly, the number of religion-based charges filed actually decreased for the next three consecutive years following FY 2002 until FY 2006, when the same charges filed increased 8.5%. What about FY 2007? Religion-based charges increased 13.34%! Consider just a sampling from some recent headlines:
